MachinesBroker operates as a brokerage company, facilitating the sale and acquisition of used industrial equipment through marketing and promotional activities.
Users wishing to list their equipment on the website are required to sign a sales mandate with a variable duration (minimum 90 days). Under this mandate, the seller commits, in the event of a sale carried out by MachinesBroker, to pay MachinesBroker a commission for the service performed. A commission is also due from the buyer to MachinesBroker.

Payments must be made once the invoice for the equipment has been issued. The invoice must clearly specify the equipment description and any included accessories and/or services. Bank transfer and irrevocable confirmed letter of credit are the only accepted forms of payment, unless otherwise agreed in writing. Should the buyer fail to comply with the payment terms, MachinesBroker is authorized to apply interest at an annual rate of 8% plus Euribor. All direct and indirect costs incurred by MachinesBroker for the recovery of unpaid amounts will be charged to the buyer.

The shipping date of the equipment is indicated on the order form. If the seller believes they cannot deliver the equipment on the agreed date, they must immediately notify MachinesBroker with adequate notice. In such cases, MachinesBroker reserves the right to:
a) cancel the order;
b) reschedule the order;
c) grant the delivery delay.

Unreported delays, missing deliveries or incomplete deliveries entitle MachinesBroker to:
a) cancel payments;
b) reject the shipment and request delivery according to agreements;
c) request repairs or replacement of damaged or missing parts.

Each delivery must include a shipping document containing all order details.

MachinesBroker relies on the information provided by sellers regarding the condition and specifications of the listed equipment. Before purchasing, buyers are required to request any technical data or additional information that may influence their final decision, in order to avoid misunderstandings and ensure maximum transparency. MachinesBroker does not provide warranties regarding the equipment listed for sale. Warranty packages are considered optional services and are subject to MachinesBroker’s evaluation.

MachinesBroker is not responsible for missed payments, failed deliveries or interrupted sales. MachinesBroker cannot guarantee the solvency of any buyer nor the reliability of any seller. Equipment availability may be updated without notice. Listings may contain typographical errors or inaccuracies for which MachinesBroker assumes no responsibility.

The MachinesBroker website and its connected services may experience interruptions or malfunctions due to external causes or force majeure beyond the direct control of MachinesBroker. Neither MachinesBroker nor any of its affiliates, employees or collaborators shall be liable for damages arising from the use of the website, its services or its applications.

MachinesBroker may offer technical assistance, maintenance services and warranty packages. These services apply exclusively to equipment belonging to the Trencher & Trenchless categories and to all other machinery purchased directly from MachinesBroker, not to equipment acquired elsewhere.

Registration on the website allows the user to receive periodic newsletters about MachinesBroker updates, leave comments on the blog, and be recognized as a verified member of MachinesBroker. Registration is restricted to users aged 18 or older. Access credentials must remain private and must not be shared with third parties who may unknowingly violate these Terms and Conditions. Any unauthorized access or theft of login credentials must be reported immediately.

MachinesBroker will not disclose or sell contact information to third parties. Personal data will be used exclusively by MachinesBroker employees to ensure proper support and correct use of our services.

These Terms and Conditions remain valid without interruption from the moment of acceptance. In the event that the equipment is sold through other channels, the user is required to notify MachinesBroker so that the agreement between the parties may be terminated.
